REGULATIONS
- REGULATIONS of the WILMAX.EU INTERNET STORE (effective as of January 15, 2026).
- 1 General provisions and definitions
- The online store available at https://wilmax.eu (hereinafter referred to as the “Platform” or the “Store”) is operated by: Wilmax Europe Sp. z o.o. ul.Krasnowolska 50, 02-849 Warsaw NIP: 9512521066, REGON: 389168608, KRS: 0000905740 e-mail: office@wilmax.eu, tel. +48 793 105 251 (hereinafter referred to as “Seller” or “us”).
- The platform operates on an online store model.
- The terms used in the Regulations shall mean:
- Buyer – a natural person with full legal capacity, a legal person or an organizational unit without legal personality who uses the Platform, in particular places an order;
- Consumer – A buyer who is a natural person making a legal transaction not directly related to his business or professional activity;
- Entrepreneur on the rights of a consumer – an individual who enters into a contract directly related to his business activity, when it is clear from the content of the contract that it does not have a professional character for that person (Article 38a of the Law on Consumer Rights);
- Seller – an entrepreneur conducting sales through the Platform, indicated in the product card and in the confirmation of the conclusion of the contract;
- Sales contract – a sales contract concluded at a distance between the Buyer and the Seller through the Platform.
- 2 Conclusion of sales contract
- All products presented on the Platform constitute an invitation to conclude a contract (invitatio ad offeriendum).
- Placing an order by the Buyer constitutes an offer to conclude a sales contract.
- The contract of sale is concluded when the Seller accepts the order – the Buyer receives an automatic e-mail confirming the conclusion of the contract on a durable medium.
- In confirmation of the conclusion of the contract, the Buyer receives:
- Seller’s identification and contact information,
- the full terms and conditions of the relevant Vendor (if different from this one),
- Information about the right of withdrawal, warranty, complaints and return costs.
- 3 Prices and shipping costs
- Prices quoted on the Platform are gross prices (including VAT).
- Shipping costs may be added to the price of the product – their amount is clearly indicated before placing the order and depends on the country of shipment and method of delivery.
- The total price including shipping costs is shown in the order summary before finalizing the order.
- 4 Methods of payment
- Payments are made through third-party payment operators (including Przelewy24, PayPal, payment cards, BLIK, traditional transfer).
- The seller does not store the Buyer’s payment card data.
- Order processing begins after the Seller receives information about successful payment (in the case of payment by traditional bank transfer – after the funds are credited to the Seller’s account).
- 5 Delivery
- The Seller’s warehouse takes a maximum of 5 working days to deliver the order. Further delivery time depends on the Buyer’s location and the selected delivery method.
- Delivery is carried out by courier companies or other entities designated by the Seller.
- The risk of accidental loss of or damage to the item passes to the Buyer at the time of delivery of the item to the carrier (Article 548 § 3 of the Civil Code), unless the Buyer has chosen a method of delivery other than that proposed by the Seller, in which case the risk passes at the time the item is delivered to the Buyer.
- 6 Right of withdrawal
- Consumers and Entrepreneurs on the rights of consumers have the right to withdraw from the contract within 14 days of taking possession of the product without giving any reason.
- The deadline for withdrawal expires after 14 days from the date:
- a) in which the Consumer took possession of the thing or in which a third party other than the carrier and indicated by the Consumer took possession of the thing – in the case of a contract obliging to transfer ownership of the thing;
- (b) conclusion of the contract – in the case of a contract for the delivery of digital content not delivered on a tangible medium.
- To exercise the right of withdrawal, the Consumer shall make a clear statement to the Seller via e-mail at office@wilmax.eu.
- The Seller will immediately send the Consumer an acknowledgement of receipt of the withdrawal statement.
- The consumer should send the returned goods to the address: Wilmax Europe Sp. z o.o. 50 Krasnowolska Street, 02-849 Warsaw, Poland. It is the Consumer’s responsibility to properly pack the goods to avoid damage during transportation. Responsibility for damage to the goods during transport in case of return of goods is borne by the Consumer.
- The seller shall return all payments received, including the cheapest delivery cost offered by it, within 14 days of receipt of the cancellation notice, subject to paragraph. 7.
- The payment is refunded using the same method of payment used by the Consumer, unless the Consumer agrees to a different method.
- The seller may withhold reimbursement until it receives the item back or provides proof of its return.
- The consumer bears the direct costs of returning the item.
- The consumer shall be liable for any diminution in the value of the thing resulting from use beyond what is necessary to ascertain the nature, characteristics and functioning of the thing.
- 7 Complaints and warranty
- The Seller is liable to the Consumer and Entrepreneur under the rights of the consumer under the warranty for physical and legal defects of the item under the terms of the Civil Code (24 months from the release of the item).
- Complaint should be reported to the Seller by e-mail at office@wilmax.eu, or by phone at +48 793 105 251
- The seller will respond to the complaint within 14 calendar days.
- Some products may be covered by an additional manufacturer’s or Seller’s warranty – the terms of the warranty are then stated in the product card and/or included in the shipment.
- 8 Transport damage
- In case of visible damage to the packaging or product caused in transit, the Consumer shall:
- Prepare a damage report in the presence of the courier (recommended),
- report the damage to the Seller within 48 hours of receipt of the shipment directly to the Seller.
- Failure to report the damage within the above period does not deprive the Consumer of warranty rights.
- 9 Personal data and newsletter
- The administrator of the Buyers’ personal data is the Operator and, in terms of contract execution, the relevant Seller.
- For detailed information on the processing of personal data, please refer to the Privacy Policy available at https://wilmax.eu/polityka-prywatnosci.
- Provision of data is voluntary, but necessary for the conclusion and execution of the contract.
- 10 Services provided electronically
- The Operator provides the following electronic services free of charge: browsing the Platform, customer account, order form, newsletter.
- Technical requirements: a device with Internet access, a current web browser with JavaScript and cookies enabled.
- Complaints about the operation of the Platform should be submitted to office@wilmax.eu.
- 11 Final provisions
- The regulations are available at https://wilmax.eu/regulamin.
- The Operator reserves the right to amend the Terms and Conditions. The changes come into force within 14 days from their announcement. Orders placed prior to the entry into force of the changes are carried out under the existing rules.
- In matters not covered by these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
- Any disputes will be resolved amicably, and in the absence of an agreement – by a court of competent jurisdiction under Polish law. In addition, the consumer has the opportunity to use out-of-court ways of dealing with complaints and claims (ODR, mediators at the OCCP).
The regulations enter into force on December 1, 2025.
