PRIVACY POLICY

  1. PURPOSES AND SCOPE OF PERSONAL DATA PROCESSING

The administrator of the personal data of the users of the online store available at https://wilmax.eu is WILMAX EUROPE Sp. z o.o., 50 Krasnowolska Street, 02-849 Warsaw (“Administrator”, “we”).

Depending on the functionalities used, services and orders placed, we may process different categories of personal data, in particular:

  • identification data (name, surname),
  • contact information (e-mail address, telephone number, mailing address),
  • Financial and transactional data (information on payments, purchases, returns),
  • Store usage data (IP address, device data, cookies, geolocation data – if the user agrees),
  • data on shopping preferences and activity history,
  • Commercial information (e.g. Newsletter membership).

Provision of data marked as mandatory is necessary to use a given function (e.g. placing an order, registering an account). Failure to provide them may make it impossible to provide the service.

We process user data for the following purposes:

  1. User account registration

We process data in order to create and operate your account, provide access to its functions, enable you to edit your data, view your purchase history and manage your account settings.

It is also possible to register/log in using your Facebook account or other social networks – in this case, with your consent, we receive your login data and email address. Public profile data (e.g. name, photo) may also be transferred. The user can manage this scope in the settings of the respective social network.

  1. Performance of the contract of sale or provision of services by electronic means

We process data for the purpose of:

  • handling orders, payments and deliveries,
  • Contact in matters related to the implementation of the contract,
  • handling returns, complaints and claims,
  • to provide a function for saving payment data for subsequent purchases (if the user agrees),
  • To ensure the security of transactions and prevent fraud.
  1. Handling inquiries and customer contact

We process data to the extent necessary to respond to inquiries sent through contact forms, e-mail, telephone or other available channels.

  1. Marketing

As part of marketing, we process data for the following purposes:

  • Sending Newsletters (e-mail, SMS, push notifications – with the user’s consent),
  • to present offers tailored to the user’s preferences,
  • Promotional activities, contests, loyalty programs,
  • Analysis of shopping behavior and browsing history to personalize your offerings (profiling).

You may opt out of marketing communications at any time.

  1. Analysis, statistics and improvement of store functionality

We process your usage data for the following purposes:

  • conducting statistical analysis,
  • Improving the operation of the store,
  • testing new features,
  • customer satisfaction surveys.
  1. LEGAL BASIS AND DURATION OF DATA PROCESSING

  • Legal basis: your consent (Article 6(1)(a) of the RODO).
  • Processing period: until the account is deleted.
  1. Implementation of the sales contract / provision of services
  • Legal basis: performance of a contract (Article 6(1)(b) of the DPA), legitimate interest of the administrator (ensuring security of transactions, Article 6(1)(f) of the DPA), consent (storage of card data).
  • Processing period: for the period necessary for the execution of the contract and handling of claims; selected data (e.g., card data) – as decided by the user.
  1. Handling customer inquiries
  • Legal basis: performance of the contract or legitimate interest of the administrator.
  • Processing period: for the time necessary to respond.
  1. Marketing
  • Legal basis: user consent, legitimate interest of the administrator (personalization of content), defense against claims.
  • Processing period: until you withdraw your consent or object; data related to promotional campaigns – for 7 years after the end of the campaign.
  1. Analysis and statistics
  • Legal basis: legitimate interest of the administrator.
  • Processing period: until the activity in question is completed or the data is anonymized.

At the end of the processing periods, the data is deleted or anonymized, unless further storage is required by law (e.g. accounting).

III. SHARING OF PERSONAL DATA

We may transfer personal data to entities that cooperate with us to the extent necessary to provide services, including:

  • Financial and payment institutions,
  • entities providing IT and hosting services,
  • courier and logistics companies,
  • To entities providing customer service,
  • marketing and advertising companies,
  • entities engaged in fraud detection.

All of these entities process data on the basis of processing entrustment agreements and only to the extent indicated by the Administrator.

Provision of data to authorities such as the police, the court or the prosecutor’s office takes place only in cases prescribed by law.

  1. RIGHTS OF DATA SUBJECTS

The user has the right to:

  • access to their data,
  • their correction,
  • deletion (“right to be forgotten”),
  • processing restrictions,
  • data portability,
  • Object to processing based on legitimate interest,
  • revoke consent at any time (without affecting the lawfulness of processing prior to revocation).

The user also has the right to file a complaint with the President of the Office for Personal Data Protection.

  1. THIRD PARTY DATA

If you provide us with the personal data of third parties (e.g., the data of the consignee of a shipment), you represent that you have informed these third parties of the processing rules and obtained their consent, if required. The third party may confirm their data directly with the Administrator.

  1. PRIVACY POLICY CHANGES

The Privacy Policy is subject to change. We will inform you of significant changes through the service, announcements on the site or e-mail. We recommend that you regularly review the current version, which is always available on the store’s website.

VII. COOKIES PLICKS

The store uses cookies and similar technologies for the following purposes:

  • To ensure the proper operation of the service,
  • Analyze traffic and improve site performance,
  • Personalization of content and advertising (with the user’s consent).

VIII. TERMS AND CONDITIONS OF USING THE STORE

Use of the site implies acceptance of this Privacy Policy. If you do not accept its contents, you should stop using the store.

  1. EXECUTION OF ORDERS

In order to complete the order, data is required:

  • name,
  • Company name and TIN (if applicable),
  • Delivery address and/or billing address,
  • email address,
  • phone number.

This data allows for proper processing of the order, contact with the customer and delivery of goods.
